Can the Senate waive their legal obligation to “consent and confirm”?

I’ve not heard any constitutional scholars weigh in but if the Republican controlled Senate lead by Mitch McConnell have their way and refuse a hearing to any Obama nominee to the Supreme Court have they effectively waived their opportunity to “consent and confirm” under the Constitution?  If so, who confirms the nominee?
